Singer Kelly Khumalo’s lawyer, Magdalene Moonsamy has pulled out as her legal representative in the murder case of slain Bafana Bafana captain Senzo Meyiwa.
Moonsamy has reportedly sent a notice of withdrawal to the National Prosecuting Authority (NPA).

Moonsamy was a watching brief on behalf of Khumalo without being directly involved in the trial.
Kelly Khumalo is expected to take the stand soon at the ongoing trial at the Gauteng High Court in Pretoria as the NPA confirmed that all the people who were present when Meyiwa was murdered will be the first to give their accounts of what happened that fateful night. Her sister Zandile Khumalo is currently on the stand giving her testimony.

Meyiwa was shot dead on 26 October 2014 at the home of his girlfriend and singer Kelly Khumalo in Vosloorus, Gauteng in an alleged botched robbery.
Meyiwa’s close friends Mthokozisi Thwala, Tumelo Madlala as well as Longwe Twala, singer Kelly Khumalo, her mother Ntombi Gladness Khumalo, her sister Zandie Khumalo and her two children Christian and Thingo were present when the goal keeper was shot.

LAWYER EJECTED FROM COURT
Moonsamy was thrust into the spotlight when she was given her marching orders in the early stages of the Meyiwa murder trial ‘to preserve the purity of court processes’.
It was argued that Khumalo, who allegedly witnessed the fatal shooting in 2014, cannot be given the luxury to ‘tailor her evidence’ based on the testimony of others. The singer’s lawyer gladly complied.

Former presiding Judge Tshifhiwa Maumela told Moonsamy that her presence could end up ‘compromising the quality of evidence’ Kelly Khumalo may eventually be asked to provide.
“You will excuse us, as to what you do when you are outside is not in our terrain. People who feature as witnesses or potential witnesses are requested to exit the courtroom.”
“They are not supposed to sit in and listen to evidence if they will be called later, because we don’t want anybody to tailor their evidence after what they have heard. They should testify from what they know. Even if you are called as defence witness if you sit in you compromise the quality of the evidence you are going to give.” – Judge Tshifhiwa Maumela
In late 2022, Moonsamy made an application to conduct a watching brief and to have access to transcript from court proceedings and copies of two dockets in the matter but the Gauteng High Court in Pretoria stood by its earlier ruling regarding Moonsamy’s presence in court.
