Retired South African Judge Robert Nugent has dismissed all the submissions made by Advocate Dali Mpofu, requesting the SARS inquiry be suspended, pending the completion of former SARS Commissioner Tom Moyane’s disciplinary hearing.
Nugent said “all the rulings and relief sought by Mr Moyane are refused”. This means Moyane has failed to make the SARS inquiry stop for now.
Nugent said Mpofu’s submission to have the SARS commission discontinued because Moyane has another hearing holds no value, because the SARS inquiry is not solely based on Moyane.
Moyane’s lawyer, David Mabuza is set to approach President Cyril Ramaphosa.
Mabuza reacted to today’s ruling, saying: “It is up to the President to decide what he wants to do to our rulings, ultimately if the President decides that he agrees with Judge Nugent then it is up to the court to tell us whether what we are asking for is fair or not. We are not perturbed by what happened.”
