The Pretoria Magistrate Court on Wednesday postponed the Dros Rape Case case to next year, as Weskoppies Psychiatric Hospital does not have a bed available to admit the accused, Nicholas Ninow, for psychiatric testing.
Ninow (20) is accused of allegedly raping and sexually assaulting a six-year-old child in the toilets at a Dros restaurant in Silverton, Tshwane. A video of angry customers confronting Ninow after the incident went viral on social media in September.
Dr Nomafrench Mbombo – DA Spokesperson on Women – blamed today’s delay on the ANC’s failure to provide a functioning health system and said “justice delayed is justice denied”.
Ninow is apparently the 14th in a queue of people waiting for a bed at Weskoppies Psychiatric Hospital, where he has been referred for mental observation.
Dr Mbombo said:
The alleged perpetrator of this heinous crime is now able to momentarily escape justice and accountability while this young girl and her family live with the horror and fear of what happened that day.
Ninow’s defence lawyer told the court today that his client was diagnosed with bipolar disorder in 2013, and has been a drug user since he was 14. He had allegedly also suffered from depression and tried to commit suicide.
According to a News24 exclusive, the substance found on Ninow at the time of the incident has been identified as cocaine.
